If voters approve the “ fair tax” amendment, lawmakers would have the legal authority to charge any income tax rate to any taxpayer. The ballot description inaccurately states the amendment grants lawmakers the power to “impose higher income tax rates on higher income levels.” In fact, the amendment simply gives lawmakers the ability to charge different rates to different income groups, not merely for those with “higher income levels.” That potentially violates the “free and equal elections” clause of the state constitution.
